Position Summary:
The VP of Contested Foreclosure Litigation will manage the contested foreclosure staff and portfolio of contested foreclosure cases and bankruptcy cases. This will include assigning matters to individuals on the contested foreclosure team, conducting side by sides with the team to ensure appropriate case management, evaluating team performance, and escalating high risk matters to senior level staff, preparing the team for monthly case review meetings with clients and preparing summaries and client reports. The VP of the Contested Team will interact with clients, Servicing Operations leadership and will work closely with the VP of Litigation. This position will also require the VP to manage a small caseload of contested matters. Additionally, the VP role will provide assistance and support with oversight of default firms by participating as the designated legal member of the default firm oversight program, working closing with Vendor Management Oversight and Foreclosure and Bankruptcy management in addressing issues and risk remediation efforts with default firms; acting as a designated point of contact with default firms; and reviewing performance of default firms handling contested matters, Responsibilities will also include reviewing and supporting Legal, Compliance, Correspondence and Servicing Operations in the investigation and review of complaints related to foreclosure or bankruptcy issues and participating in remediation efforts to address the root cause of the complaint with Servicing leadership. The VP role will also provide support interpreting and summarizing new laws and regulations related to foreclosure and bankruptcy, providing guidance and direction to Compliance and Servicing Operations.
Essential Duties and Responsibilities include the following:

Oversee contested foreclosure and bankruptcy portfolio of cases, title curative cases, and matter assignments to team to ensure proper matter management.

Manage a large team of experienced contested case managers, providing staff with regular performance feedback via scorecards and other forms of communication.

Discuss matters and provide legal advice and strategy recommendations to contested case managers and outside law firms.
-
Work closely with litigation team to analyze settlement offers. Review and approve settlement agreements.
-
Provide timely and accurate reporting on caseload to investors and business partners.
-
Work closely with the SVP-Litigation to formulate strategy for resolution of contested matters.
-
Assign all new matters received in LPS system, the Litigation centralized mailbox and Legal Tracker to the appropriate team member in a timely manner.

Manage maintain and update Policies and Procedures related to Contested Foreclosure and legal Title Curative.
-
Maintain responsibility for management of shared mailboxes (including, but not limited to, Litigation and ROGGS) to ensure all inquiries are delegated and responded to in accordance with department P&P.

Notify GC and SVP of Litigation of high-risk matters upon intake (class actions, Selene named, etc.).

Update the litigation database and reports with current information of the status of the litigation, strategy currently used, and upcoming critical events, and dates.

Generate daily reports to ensure team compliance with timekeeping requirements.

Provide training to new and existing litigation staff and Corporate Appearance team as requested.

Assist with guidance, direction, and leadership of contested and litigation staff.
-
Provide additional coverage of litigation matters when individual team members are out of the office.
-
Schedule trainings/CLE’s for the team with internal resources and outside firms.

Prepare summary of case and discusses with counsel and investors, as needed.

Track and follow-up on hearings, motions, pleadings, etc.
-
Provide support to and works closely with the Corporate Appearance and Mediations team on contested matters and recommend mitigation actions to reduce future occurrences of the same issue.

Analyze industry case decisions and potential impact on Selene operations and clients.
-
Assist with the investigation and review of escalated complaints and responses; recommend mitigation measures to prevent future incidents.

Identify gaps in company policies and procedures which allow breakdown leading to contest or litigation and makes suggestions to correct processes, if applicable.

Manages inquiries by responding to emails, intercoms, handling appropriate document execution, and other related tasks.

Work closely with VMO and default servicing on scorecards, audits, case file reviews, file transfers, risk mitigation and performance of default firms.

Periodically review engagement terms and remediation documentation for default firms to address current developments.

Assist with updating risk profiles of the default firm network.

Establish internal controls to reduce errors and customer complaints related to contested matters.

Develop and maintains department policies and procedures related to contested matters.

Provide coaching, training, and development to staff to ensure company and department goals and key performance indicators (KPIs) are met.

Measure and document staff performance, attendance and compliance with job duties, expectations, regulations, guidelines, policies, and procedures.

Education/Experience: Juris Doctorate degree from an accredited university, and at least seven years related experience as a litigation associate, foreclosure/bankruptcy litigation specialist, title specialist or in a related area in mortgage servicing. Additionally, a minimum of three to five years of related experience and/or training is required. At least two years' experience in supervisory or team lead role is required. Must have experience in residential mortgage servicing.

Ability to respond to common inquiries or complaints from customers, regulatory agencies, or members of the business community. Ability to write speeches and articles for publication that conform to prescribed style and format.
