Investigates, evaluates and resolves complex litigated claims. Preparation of claim file for presentation with defense counsel on property and liability litigation files. Develops and partners with defense counsel in pursuing effective and cost-effective litigation strategies. Executes final resolution of the claim file. Ensures that prompt and courteous handling of litigated claims is provided to policyholders. Attends trials, mediations and depositions by phone or in person as needed. When appropriate, contacts and negotiates lawsuits direct with plaintiff attorneys. Places special emphasis on complying with established claim and litigation guidelines.
ESSENTIAL FUNCTIONS
Lawsuit Assignment
Receives new lawsuits from the manager to handle direct and to make assignment to defense counsel. Ensures prompt contact is made as per established guidelines. Ensures suit files are assigned and suits answered in a timely fashion. Works pending lawsuits to ensure efficient completion. Reviews policy information to determine applicable coverage(s). Makes recommendations to the manager for resolution of coverage issues in accordance with policy language, customer and company guidelines, and generally accepted claims handling procedures.
Reserves
Recommends timely and accurate reserves based on the claims analysis and defense counsel recommendations to ensure sufficient funds can be allocated to cover potential losses. Monitors reserves as the lawsuits progress and makes adjustments as circumstances warrant.
Lawsuit Resolution
Works with defense counsel to develop litigation plan to bring case to a posture for resolution by negotiation, mediation or continued litigation. Responsible for staying current on legal trends that affect claim handling in the appropriate state(s).
Reporting
Maintains a current diary on each claim to ensure timely resolution and closing of the file. Provides detailed captioned reports for management review on major losses. Consistently follows up with defense counsel as needed. Ensures files are fully documented and able to support the decisions made.
Customer Service
Ensures prompt, proper contact is made and maintained with customers, insureds, agents and attorneys.
Training
Assists the claims manager as needed in mentoring less experienced examiners. Assists in identifying training needs and aids in the development, administration, and evaluating of training programs.
Requirements
•4-year college degree plus 7 years of property, liability and litigation claims handling experience, or a comparable combination of education and experience.
•Working knowledge and in-depth experience to understand and interpret a property damage estimate.
•Able to interpret policy coverages applicable to the line of business.
•Working knowledge and in-depth experience evaluating liability exposures.
•Proven and effective negotiation skills.
•Demonstrates technical expertise in claims management including but not limited to the understanding of coverage, forms, contracts, and tort law.
•Computer literacy and ability to use applicable software. Preferred experience with Guidewire, MSP Navigator, Xactimate, and Office 360.
•Adjusters home state license required and the ability to obtain any additional state licenses as required.
•Insurance certificates, courses, or professional designations a plus.
